The Licensing Matters Due Diligence Package

What is Due Diligence?

‘Due Diligence’ is a defence in law. It means being able to prove that all the correct policies and procedures are in place to prevent the sale of alcohol to a person under the age of 18. If a member of staff were then to sell alcohol to a child the business owner would be able to show that it was a mistake and that the policies and procedures in place meant that it should not have happened. It is the only way for business owners and their supervisors to protect themselves from a prosecution.

Everyone who holds a premises licence is expected to understand their responsibilities. It is not acceptable to say – ‘I didn’t know the law’, or ‘I didn’t know I had to train my staff’. Unfortunately, despite the amount of revenue an alcohol licence brings to businesses, many owners do not realise their responsibilities.

Licensing Matters have developed a comprehensive package that, when used as directed, would provide a Due Diligence defence.

The Due Diligence training package

This package contains everything needed to establish best practise in relation to complying with the law, and particularly with preventing the sale of alcohol to children. It contains comprehensive advice and information about the licensing system. It is a staff training package and provides all the tools needed to establish comprehensive procedures relating to the sale of alcohol.

The package includes:

· A Designated Premises Supervisor manual which includes information and guidance on licensing.

· A staff training manual.

· Question papers which include a variety of multiple choice questions, true or false, crosswords and scenarios.

· All the relevant forms and authorisation documents.

· An individual staff training file for each staff member.

· A ‘Store Alcohol & Children Policy’ specifically tailored to each individual store.

· Posters.

· Refusals & Incident Register.

· Comprehensive & easy to understand instructions of how to train staff and use the Refusals and Incident Register.

What makes the pack so vital for my business?

The Licensing Matters Due Diligence package is the first product of its kind on the market. The package has been developed because Licensing Matters are increasingly being employed to assist operators who have found themselves in trouble with their alcohol licence. Businesses which, had they had a comprehensive training system in place from the start, would never have ended up facing the loss of their licence.
